3/21/2020 Minister of Justice: All small claims cases are managed entirely electronically

His Excellency the Minister of Justice, Islamic Affairs and Endowments, Sheikh Khalid bin Ali Al Khalifa, and after the approval of the Supreme Judicial Council, issued Decision No. (35) of 2020 approving the application of the complete electronic system to all civil and commercial cases in which the claim value does not exceed 1,000 dinars.

According to this decision, the management of small claims cases will be completely electronically, starting with registering and filing cases, sending judicial announcements, determining hearing dates, submitting and exchanging notes, and leading to the issuance of judgments, provided that the period of managing small claims claims to prepare them for pleading does not exceed one month. From the date of registering the case list, while the case management period is 10 days in the event that the defendant does not respond to it.

As stated in His Excellency the Minister of Justice’s decision to issue a list of procedures for small claims cases, the maximum number of postponements for a small claims case is (5) sessions, provided that the adjudication period does not exceed 3 months from the date of its registration, and the postponement is only for specific exceptional reasons.

According to this decision; The new system for small claims cases whose value does not exceed one thousand dinars will contribute to reducing procedures before the courts and enhancing the speed of settlement in pending cases.
