1/3/2020 Boujeri: justice plans to implement electronic and remote documentation

The Assistant Undersecretary for Courts Affairs and Documentation at the Ministry of Justice and Islamic Affairs Mohamed Boujeri revealed a package of development projects regarding the services provided by the Documentation Department, as part of its keenness to increase the efficiency of the services provided and keep pace with the increase in transactions.

These new projects come as part of a package that the Ministry has worked on in the past period, including the licensing of private notaries and writers, as the license was granted to about 33 legal persons who meet the requirements.

A group of private notaries public was authorized to carry out all business and transactions, including real estate transactions and their agencies, disposition and management agencies, as the license was granted to four of the total of 24 private notaries to carry out all business and real estate transactions. Bucceri explained that all these development initiatives aim to provide documentation services to be more responsive to the growing requirements, as more than 90,000 transactions are documented annually.

The following is the transcript of the meeting with the Assistant Undersecretary for Court Affairs and Documentation at the Ministry of Justice and Islamic Affairs, Muhammad Bucceri, with Al-Bilad newspaper:

What services does the Ministry of Justice, Islamic Affairs and Endowments provide in relation to the process of legal documentation of contracts and projects that the ministry has taken to facilitate transactions?

The Ministry launched a package of development projects in all judicial sectors, which would develop work in the judicial system, and with regard to the services provided by the Documentation Department, the decree-law was issued to amend some provisions of the Documentation Law, which authorized the Minister of Justice to grant a license to carry out all or some documentation work Notary public, where a total of 33 legal persons who met the requirements mentioned in the aforementioned decree were licensed, including 9 special notaries for female editors in English, and 24 private notaries for female editors in Arabic.

The Minister of Justice, Islamic Affairs and Endowments also issued Resolution No. (101) of 2019 regarding the authorization for a group of private notaries to carry out all business and transactions, including real estate transactions and their agencies and management and management agencies, where a number (4) of the total number of private notaries were licensed. (24) To carry out all business and real estate transactions, including documenting real estate sale contracts and real estate sales agencies and management and management agencies. The Ministry continues to enhance the role of the private notary in providing notarial services, as this provides advantages that contribute to expediting documentation work, and facilitating its procedures for individuals, companies and institutions beneficiaries by creating multiple options in terms of time and place.

Are there any facilities provided by the ministry to investors and real estate offices?

The Ministry has approved the appointment system for all transactions related to documenting companies' incorporation contracts and amending them, as these transactions are reviewed before the parties attend to document them at the Authentication Department, and investors of the owners of companies of whatever type may resort to private notaries for the same purpose. In light of the steps taken by the Ministry, a remarkable decrease was noticed in the number of transactions documented by the Ministry's notaries public regarding the documentation of companies' incorporation contracts and amending them.

As for real estate offices, as I mentioned, a number of private notaries have been authorized to carry out all works and transactions, particularly real estate, and coordination in this regard has been made with the Survey and Land Registration Bureau to overcome all the difficulties that may encounter the process of documenting those transactions, specifically real estate sales. Where the hotline was approved to respond to the inquiries of all private notaries licensed to document real estate transactions to verify that there are no legal barriers to documenting real estate sales contracts.

Are there any future projects or steps to facilitate procedures in the Documentation Department?

The Ministry is currently working on implementing the electronic documentation project as well as remote documentation, as these processes will facilitate, once approved, the service seekers to complete their transactions at the Documentation Department by obtaining an electronic copy that can be referred to and verified in all public and private agencies, as well as the procedures for remote documentation will facilitate the documentation processes without Personal attendance of the Authentication Department. All of these development initiatives aim to provide documentation services to be more responsive to the growing requirements, as more than 90,000 transactions are documented annually.
