Ms. Dana Khamis Al-Zayani, Undersecretary for Planning, Family Reconciliation and Alimony at the Ministry of Justice, Islamic Affairs and Endowments and member of the Supreme Council for Women, gave an electronic lecture entitled (Family Reconciliation and Sharia Mediation), which was organized by the Legislation and Legal Opinion Commission.
The Undersecretary for Family Reconciliation and Planning reviewed the path of forming the Family Reconciliation Office and the developmental stages of the office since its establishment in 2001, noting the issuance of Decree Law No. 22 of 2015 amending some provisions of the Law of Procedures before Sharia Courts, which constituted a qualitative leap in the office’s work through mandatory Referring family disputes to an office of the Family Conciliation Office before submitting them to the Sharia courts, in order to contribute to their consensual settlement and strive to reduce its negative effects on family life.
She appreciated the support of the Supreme Council for Women of the Family Reconciliation Office since the beginning of its establishment, which contributed to expanding the scope of the office's work in all governorates through integration with family guidance offices in the social centers of the Ministry of Labor and Social Development.
She provided a detailed explanation about the family reconciliation office's work procedures, in addition to a statement of cases that fall under the family reconciliation office's jurisdiction, including all kinds of divorce cases, custody, and alimony.
She then referred to the efforts to develop the services of the Family Reconciliation Office in light of combating the spread of the Corona virus (Covid 19), in joint cooperation with the Supreme Council for Women, where the office's work continued uninterrupted by converting family reconciliation sessions into visual sessions.
Then I reviewed Resolution No. (96) of 2021 regarding the regulation of mediation in legal issues, during which it dealt with many basic themes that focused on the types of mediators, the issues in which conciliation is permissible, the conditions for registration in the table for a natural person and a legal person, registration procedures, and criteria and conditions for a session Mediation and cases of exemption from it.
