16/1/2022 Agent of Justice: Opening the door for receiving applications for licenses

In the framework of the directives of His Royal Highness Prince Salman bin Hamad Al Khalifa, Crown Prince and Prime Minister, may God protect him, to provide the necessary infrastructure to implement the decree-law on implementation in civil and commercial matters, His Excellency the Minister of Justice, Islamic Affairs and Endowments, Sheikh Khalid bin Ali Al Khalifa, and after the approval of The Supreme Judicial Council, Resolution No. (4) of 2022 regulating the practice of private port activity.
His Excellency the Undersecretary of Justice and Islamic Affairs Judge Issa Sami Al-Mannai indicated that, according to the decision, to grant a license to practice the activity of a private port, it is required that the applicant for the license be a legal person authorized to work in the Kingdom.
His Excellency added that the legal representative of the legal person shall not have been convicted of a final verdict of a felony or misdemeanor breaching honor or trust, unless he has been rehabilitated, and he has not been previously dismissed from his job or removed from his position or his name has been crossed out from the schedule of practicing a profession By a final judicial ruling or by a final disciplinary decision, unless at least three years have passed for either of them.
Also, he shall designate at least three persons from his employees to carry out the business and procedures subject to the license as private natural executors, in accordance with the prescribed conditions, including that he must successfully pass the exams and trainings decided by the Institute of Judicial and Legal Studies, and that the representative of the legal person submits a valid insurance document for the duration of the license against liability. For professional errors, issued by one of the insurance companies licensed in the Kingdom, provided that the insurance amount is not less than thirty thousand dinars.
His Excellency the Undersecretary for Justice and Islamic Affairs announced the opening of the door to receive applications for those wishing to license to practice the work of the private port, by submitting applications to the Execution Department via e-mail Bailiffs@moj.gov.bh, by filling out the form prepared for this and published on the Ministry’s website www.moj.gov.bh, as of today, Sunday, January 16.
According to the decision, the private executor may initiate the necessary procedures to seize and sell movables, sell real estate, cars, shares and bonds, and implement in kind, with the obligation to comply with the provisions of the law and the decisions issued for its implementation and the decisions and orders issued by the judge of the execution court in this regard.
The private executor, with regard to the implementation of the persons subject to the second chapter of the law, may offer mediation to the parties to the executive document before submitting the application for execution, and in relation to the implementation of the companies subject to the third chapter of the law, he may offer mediation to the parties to the executive document within twenty-one days from the date of submitting the execution document. Execution request, and the offer of mediation shall, in all cases, be based on the request of the executor for it or the executor against it.
Regarding the procedures for offering mediation to the parties to the executive document, the provisions stipulated in Decree-Law No. (22) of 2019 regarding mediation for the settlement of disputes and its executive regulations issued by Resolution No. (126) of 2019.

The Execution Department of the Ministry undertakes the administrative inspection of the private port to verify its compliance with the duties stipulated under the provisions of the law and the decisions issued for its implementation and its compliance with the terms of the license issued to it. It also receives complaints submitted against the private port or any of the natural private enforcers working for it.
