Representatives of 13 private execution companies and their licensed employees took the oath before His Excellency Sheikh Khalid bin Ali Al Khalifa, Minister of Justice, Islamic Affairs and Endowments, to start practicing the private port activity, after completing all the requirements and conditions of the program prescribed for licensing the private port activity.
His Excellency the Minister of Justice affirmed the progress in achieving initiatives to enhance access to justice and turn it into a tangible reality, within the framework of Bahrain’s Economic Vision 2030, in accordance with the comprehensive development process led by His Majesty King Hamad bin Isa Al Khalifa, the King of the Great Country, may God protect and preserve him, and with the guidance and support of the The government is headed by His Royal Highness Prince Salman bin Hamad Al Khalifa, Crown Prince and Prime Minister, may God protect him.
His Excellency the Minister of Justice pointed out that the creation of this new profession, in light of the application of the decree-law regarding implementation in civil and commercial matters, is a fundamental and important step in adopting the new implementation system and in the framework of partnership with the private sector, and in a manner that contributes to developing the efficiency of implementation and raising the level of its effectiveness in accordance with clear paths. and specific.
His Excellency the Minister of Justice stressed the obligation of private executors to carry out the licensed works and procedures accurately, honestly and faithfully, to preserve the secrets and dignity of the profession, and to fully implement the decisions and judicial orders issued by the enforcement courts.
In accordance with the new implementation law and related decisions, the executor must seek the assistance of the private executor to complete the implementation procedures in the requests in which decisions were issued to seize the funds of the executor against him "real estate, vehicles, movables, shares and documents", which includes preparing them for sale starting from their inventory and valuation and proceeding with The procedures for selling it after the approval of the court, offering it for sale in the manner decided by the court, and distributing the proceeds of the sale.
It is also possible to seek assistance from licensed private executors to carry out notification procedures, submit an implementation request, and follow up on the actions taken.
The Execution Department of the Ministry undertakes the administrative inspection of the work of the private port to verify its compliance with the duties stipulated under the provisions of the law and the decisions issued for its implementation and its compliance with the terms of the license issued to it. It also receives complaints submitted against the private port or any of the natural private enforcers working for it.
