3/7/2022 Minister of Justice: Bahrain has made important achievements in developing the criminal justice system

The Minister of Justice, Islamic Affairs and Awqaf, His Excellency Mr. Nawaf bin Mohammed Al-Maawda, affirmed that the Kingdom of Bahrain has made important achievements in the development of the criminal justice system, both in legislation and in practice, pointing to the importance of cooperation between the executive and legislative authorities, which contributed to bringing about a fundamental change in this field, to achieve the goals of the march. Comprehensive development under the leadership of His Majesty King Hamad bin Isa Al Khalifa, King of the Great Country, may God protect him, and with the support and interest of His Royal Highness Prince Salman bin Hamad Al Khalifa, Crown Prince and Prime Minister, may God protect him.

The Minister said that among the qualitative legislations issued was the Restorative Justice for Children and the Protection of Children from Abuse Law, which gives the best interests of the child priority in all decisions and procedures related to it, regardless of the entity issuing or undertaking it, in line with international standards in this regard.

Al-Maawda pointed out that one of the most fundamental issues included in the law is the child’s social report, which will be prepared by specialists in psychological and social fields before the Correctional Justice Courts for Children and the Judicial Committee for Childhood, in light of continuous judicial oversight of the child’s condition and monitoring of his condition during the implementation of the alternative measure or punishment, and based on On the reports submitted on his condition, the report shall be made on the extent to which he continues to implement the measure or penalty, replace it with another or terminate it, with periodic follow-up of his social and psychological condition and the extent of progress and improvement in his condition.

On the other hand, he referred to the amendment to the Penal Code regarding the punishment of those who refused without excuse to enable the person entitled to visit the child in custody to visit, which comes within the framework of developing the system for protecting the family entity and ensuring that the requirements of the emotional needs of the child are met, by filling the legislative void in this aspect.
Al-Moawda affirmed moving forward in strengthening legislation concerned with the protection of children's rights and the stability of their psychological and social environment by reviewing advanced experiences and applications in accordance with the latest best practices by benefiting from international experiences.
