In the framework of strengthening the partnership with the private sector by using it to provide some judicial services, His Excellency Judge Issa Sami Al-Mannai, Undersecretary for Justice and Islamic Affairs, announced the opening of the door to receive applications for those wishing to obtain a license to practice the work of the private port, in light of the application of the law regarding implementation in civil and commercial matters. .
His Excellency the Undersecretary of Justice stated that submitting applications to the Execution Department via e-mail, Bailiffs@moj.gov.bh, by filling out the form prepared for that and published on the Ministry’s website www.moj.gov.bh, during the period from Tuesday 20 December 2022 AD until Tuesday 3 January 2023 AD.
His Excellency indicated that, according to Resolution No. (4) of 2022 regarding the regulation of practicing the activity of the private port, it is required for the granting of a license to practice the activity of the private port that the applicant for the license be a legal person licensed to work in the Kingdom.
His Excellency added that the legal representative of the legal person should not have been previously judged by a final judgment in a felony or misdemeanor breaching honor or trust, unless he has been rehabilitated, and that he should not have been previously dismissed from his work, removed from his position, or crossed out from the list of practicing a profession. By a final court ruling or a final disciplinary decision, unless at least three years have passed since either of them.
He also has to nominate at least three of his employees to practice the business and procedures subject of the license as natural private executors, in accordance with the established conditions, including that he must successfully pass the tests and training decided by the Institute of Judicial and Legal Studies, and that the representative of the legal person submit an insurance policy valid for the duration of the license against liability For professional errors, issued by an insurance company licensed in the Kingdom, onThe insurance amount shall not be less than thirty thousand dinars.
According to the decision, the special executor may directly complete the execution procedures after attachment of movables, real estate, cars, shares, bonds, and real execution, with the obligation to adhere to the provisions of the law and the decisions issued in implementation thereof and the decisions and orders issued by the Execution Court judge in this regard.
The Ministry's Implementation Department undertakes administrative inspection of the private port to verify its compliance with the duties established under the provisions of the law and the decisions issued for its implementation and its compliance with the conditions of the license issued to it. It also receives complaints filed against the private port or any of the natural private enforcers working for him.
